General Terms and Conditions (GTC) for DartsAI

§1 Operator Information

The DartsAI app is operated by:

  • Marlo Saslona, Everstalstraße 25, 44894 Bochum, Germany
  • Pablo Schmücker, Pionierstraße 22, 40215 Düsseldorf, Germany

§2 Scope

These General Terms and Conditions govern the use of the mobile application "DartsAI" between the operators and users of the app.

By registering for or using DartsAI, the user agrees to these terms and conditions.

§3 Description of Services

DartsAI is an application for recording, analyzing, and managing dart games.

The app in particular enables:

  • recognition of dart throws via camera and artificial intelligence,
  • recording of throws via voice input,
  • manual entry of throws,
  • creation and evaluation of statistics,
  • playing against other users via online features.

There is no entitlement to specific features or a permanently unchanged scope of services.

§4 Registration and User Account

Creating a user account is required for certain features.

Upon registration, the following data in particular is stored:

  • email address,
  • username,
  • encrypted password,
  • time of last activity.

The user is obliged to keep their login credentials confidential and protect them from access by third parties.

Users may delete their account at any time via the app settings.

§5 Use of AI Features

Dart throw recognition is performed automatically using artificial intelligence.

The user acknowledges that AI evaluation may contain technical errors and that no specific recognition accuracy is guaranteed.

AI recognition serves solely to assist the user. Error-free, complete, or continuously available evaluation is not owed. In particular, incorrect or incomplete results may occur due to technical limitations, insufficient image quality, lighting conditions, camera positions, or other circumstances.

Use of DartsAI by persons under the age of 10 is permitted only with the consent of a legal guardian. By registering for and using the app, the user or their legal representative confirms that the required consent has been obtained.

§6 Image Processing

Images of the dartboard are processed for the use of dart recognition.

Uploaded images are stored for a period of up to one month after capture and are then automatically deleted.

Images are not shared with third parties.

§7 Public Profiles

User profiles are publicly visible on the platform by default.

Users can set their profile to "Private" in the app settings or disable the display of game and performance statistics.

The following information may be displayed to other users:

  • username,
  • game and performance statistics,
  • time of last activity.

Email addresses are not displayed publicly.

§8 DartsAI Pro and Subscriptions

Certain features may only be used as part of a paid subscription.

Subscriptions are processed through the respective app stores.

Billing, management, cancellation, renewal, and handling of any right of withdrawal are carried out through the respective platform providers (Apple App Store or Google Play Store) in accordance with their terms.

Unless otherwise stated, subscriptions automatically renew for the selected term.

Where consumers have a statutory right of withdrawal, its exercise is governed by the terms of the respective platform provider.

By beginning to use paid digital content before the withdrawal period expires, the user expressly agrees that performance of the service begins immediately. The user is aware that their right of withdrawal may thereby expire in whole or in part in accordance with applicable law.

§9 User Obligations

The user agrees to:

  • use only lawfully obtained content,
  • not circumvent technical protection measures,
  • not misuse the app,
  • not carry out automated attacks or manipulation attempts,
  • upload only images required for dart evaluation.

§10 Suspension of User Accounts

In the event of violations of these GTC or misuse, the operator may temporarily or permanently suspend user accounts.

There is no entitlement to restoration of the account.

§11 Availability

DartsAI is operated with great care.

However, uninterrupted availability of the services cannot be guaranteed.

Maintenance work, technical disruptions, or force majeure may lead to restrictions or temporary outages.

§12 Liability

Use of the app is at the user's own risk.

The operators are fully liable for intent and gross negligence as well as in cases of mandatory statutory liability.

For simple negligence, the operators are liable only for breach of essential contractual obligations and limited to foreseeable, typical contractual damage.

Liability for incorrect AI results, data loss, outages, or lost profits is excluded to the extent permitted by law.

§13 Changes to the App and GTC

The operators are entitled to adapt, expand, or discontinue features of the app.

Changes to these GTC will be communicated to users with a notice period of at least 30 days in an appropriate manner, for example by email or in-app notification.

Material changes require the express consent of users.

If a user does not agree to a change, they are entitled to terminate the contractual relationship at the time the change takes effect.

§14 Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

Mandatory consumer protection provisions of the user's country of residence remain unaffected.

§15 Final Provisions

Should individual provisions of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
